The number of securities class action lawsuit filings increased in 2023 for the first time in four years, according to a new report from NERA. According to the report, the number of filings increased more than 10% in 2023 compared to 2022. On the other hand, the number of cases resolved in 2023 declined during the year. The total number of securities class action lawsuit settlements reached the highest level in 15 years in 2022, and median, average, and aggregate settlement amounts also rose significantly in 2022 compared to the year prior, according a recently published annual report from Cornerstone Research. The report, entitled “Securities Class Action Settlements: 2022 Review and Analysis,” analyzes the 105 securities class action lawsuit settlements finalized in 2022 and compares them statistically with prior years’ settlements. Federal court securities class action lawsuit filings declined 22% in 2020 compared to 2019, but the 2020 filings were still above the long-term historical average annual numbers of filings, according to NERA Economic Consulting’s annual securities litigation report. The 2020 securities suit filing drop-off reflected a decline in the number of federal court merger objection class action lawsuits filed during the year, offset in part by the number of coronavirus-related securities suits.
